Terms of Service

These terms govern your use of thebetterathlete.io. Two sections matter more than the rest: what our coach review actually is, and the physical risk of athletic training. Read those even if you skip everything else.

1. Who may use TBA

You must be at least 18 to enter into these terms. If the athlete is under 18, a parent or legal guardian must accept these terms on the athlete's behalf, supervise the account, and is responsible for all activity on it and all charges incurred.

2. What TBA is

TBA is a marketplace and a set of software tools. We connect athletes and their families with independent performance coaches, and we give those coaches software to run their practice.

Coaches are independent contractors, not our employees. We do not employ, supervise, direct, control, or attend coaching sessions. The coaching relationship is between you and the coach. We are not a party to it.

3. How coaches get onto TBA

No coach can list themselves. Every application is reviewed by hand and personally approved by our founder before that coach becomes visible to any athlete or family. There is no automatic, self-serve, or instant path onto this platform. If a coach appears here, a named human decided to let them in and is accountable for that decision.

What that approval is, and what it is not.

Approval means we have reviewed the coach's application and decided to admit them. It is a judgement about the application in front of us.

It is not, at present, a verification. We do not currently run criminal background checks. We do not independently confirm certifications, licences, insurance, or identity. Certifications shown on a coach profile are stated by that coach and have not been confirmed by us.

We are direct about this because the distinction matters to a parent. A human gatekeeper is a real control, it is why we can remove a coach the moment we have a concern, and why nobody arrives here anonymously. But it is not the same as a background check, and we will not let you believe it is.

If you are a parent, you remain responsible for satisfying yourself that a coach is appropriate to work with your child. We encourage you to ask for credentials, references, and proof of insurance directly, and to be present at sessions with a minor.

We intend to introduce criminal background checks and identity verification. When we do, this section will be rewritten to state exactly what is checked, by whom, and how often it is re-checked, and only then will we describe our coaches as verified or background-checked. Until you read that here, assume we have not done it.

4. Assumption of risk, athletic training

Physical training carries a risk of injury, including serious injury, permanent disability, and death. That risk cannot be eliminated by any coach, program, or platform.

By using TBA, you acknowledge and voluntarily assume these risks for yourself and, if you are a parent or guardian, on behalf of your athlete.

Training plans, nutrition guidance, and any other content on TBA are for general educational purposes and are not medical advice. They are not a diagnosis, treatment, or a substitute for care from a qualified medical professional.

You should obtain medical clearance before beginning any training program, particularly for a growing athlete. Stop immediately and seek medical attention if pain, dizziness, or distress occurs. Disclose any relevant medical condition or injury to the coach before training.

5. Accounts

Provide accurate information and keep it current. You are responsible for keeping your password confidential and for everything done through your account. Tell us promptly if you suspect unauthorised access. One person per account; do not share credentials.

6. Payments

Session fees are set by the coach. Coach subscription fees are set by us and shown before purchase. Payments are processed by Stripe and subject to Stripe's terms. Fees are in US dollars. Applicable taxes may be added.

Cancellation, rescheduling, and refunds are covered by our Refund Policy, which forms part of these terms.

7. Acceptable use

Do not: use TBA if you are barred from working with minors; harass, endanger, or exploit any user, especially a child; misrepresent your identity, credentials, or qualifications; take payment or coaching relationships off-platform to avoid fees; scrape, reverse engineer, or attack the service; upload unlawful, infringing, or harmful content.

Coaches working with minors must comply with all applicable child-protection law, and must not communicate with a minor athlete outside the platform without the knowledge and consent of that athlete's parent or guardian.

We may suspend or terminate any account, at any time, where we believe a child's safety is at risk. We will not wait for proof.

8. Content and intellectual property

TBA and its content, software, design, text, and training material we produce, belong to us. You get a limited, personal, non-transferable licence to use the service. Programs and guides purchased from us are licensed for the purchaser's personal use and may not be resold or redistributed.

Content you submit remains yours. You grant us a licence to host, display, and process it as needed to run the service.

9. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any particular athletic result will follow.

We make no warranty as to the conduct, competence, qualifications, or safety of any coach.

10. Limitation of liability

To the fullest extent permitted by law, TBA and its founder are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total aggregate liability arising from the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by our own negligence, or for fraud.

11. Indemnity

You agree to indemnify TBA against claims arising from your breach of these terms, your misuse of the service, or, if you are a coach, your provision of coaching services.

12. Termination

You may close your account at any time. We may suspend or terminate access for breach of these terms, for risk to any user, or where required by law.

13. Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict of law rules. Disputes will be brought in the state or federal courts located in Broward County, Florida.

14. Changes

We may update these terms. Material changes will be notified by email or in-app. Continued use after a change means acceptance.
